General
The client is hereinafter referred to as you/your.
The Secret Garden Handmade Stationery Company
is hereinafter referred to as TSG/we/our/us.
Copyright
All artwork and designs are copyright of The
Secret Garden.
You are responsible for ensuring that any material
(e.g. hymns) you ask TSG to include in your stationery does not
breach any third party copyright and you indemnify TSG against any
action brought against it in the event of any such breach.
Deposit and Payment
For wedding and social stationery orders a 50%
non-refundable deposit is required when placing your order. The
remaining balance is due upon acceptance of final proofs and must
be paid in full before any work can commence on your order. Payment
of the deposit is deemed to be acceptance of these terms and conditions.
For all other orders full payment is required
when placing your order.
All stationery prices are inclusive of VAT at
the current rate of 17.5%. Any change to this rate will be reflected
in stationery prices.
Data Protection
TSG will not disclose any information you provide
with any third party unless specifically agreed in advance by you,
for example testimonials.
Order Process
TSG will make every effort to ensure that proofs
are submitted to you in accordance with your request. It is your
responsibility to check the accuracy of the proofs before confirming
your acceptance. Any proofs submitted to you must be signed, dated
and returned to us. On receipt of signed proofs and payment of the
remaining balance we will send you confirmation of receipt (either
by email or post). We will then proceed with the production of your
stationery. Any changes, or alterations requested after returning
the signed proofs may incur an additional charge.
TSG will make every effort to ensure the final
stationery order matches the signed proof. However, as all our stationery
is handmade, designs may vary slightly. Furthermore, we cannot guarantee
continuity of colours/materials especially if separate orders are
placed for the same stationery design. If the product specifications
from our suppliers change we will endeavour to offer you an alternative
of the same or better quality at the same price as your initial
order.
Any artwork and designs created for you including
bespoke designs will remain copyright of TSG.
Delivery
All stationery orders placed with TSG are done
so on the understanding that delivery dates are approximate and
are subject to availability. We endeavour to deliver Part 1* of
your order 2 to 4 weeks from the receipt of signed proofs. Therefore
we recommend you place an order with us at least 14 weeks prior
to your wedding day. All items sent out are fully insured for loss
and damage during transit and a signature is required upon delivery.
(Part1* refers to Invitations and Reply Cards etc. - Part 2 refers
to items that require additional information from your guests' replies
- i.e. correct quantities for Place Cards, Order of Service etc.)
If we fail to deliver your order within the
agreed timescale, or agreed date, for reasons within the reasonable
control of TSG, TSG is deemed liable to you and our liability shall
be limited to the value of the stationery order. If we fail to deliver
your order with the agreed timescale, or agreed date, for reasons
beyond the reasonable control of TSG, TSG shall not be deemed liable
to you.
Delivery is usually made through Royal Mail
Special Delivery. TSG reserves the right to deliver stationery through
other carriers. Whilst we make every effort to pack your stationery
order safely and securely we cannot be held liable for loss or damage
whilst in transit.
Liability
You should be aware that some of our products
are not suitable for children.
We will take all reasonable precautions to keep
the details of your order and any payment secure. Unless we are
negligent, we cannot be held liable for any losses caused as a result
of unauthorised access to information provided by you.
Returns, Alterations and Cancellations
Any orders cancelled prior to receipt
of signed proofs will not incur any additional costs other than
the 50% deposit already paid. Any orders cancelled after receipt
of signed proofs may incur additional charges up to the full value
of the stationery order.
